Terms of Service
1. Introduction
Solva ("Solva," "we," "us") provides an online service that generates conceptual, AI-assisted visualisations of real estate properties from user-submitted photos, location data, and project briefs ("the Service"). These Terms of Service ("Terms") govern your access to and use of the Service. By uploading materials, generating images, or purchasing a package, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service.
2. Conceptual visualisation only
Every image, document, or other output Solva generates ("Output") is a conceptual, AI-assisted visualisation produced for early-stage marketing and design communication. An Output is not a survey, architectural drawing, engineering document, construction document, appraisal, or any other professional work product, regardless of how realistic it appears.
3. No professional advice
Solva does not provide architectural, engineering, surveying, legal, planning, zoning, permitting, appraisal, environmental, construction, real-estate, investment, financial, insurance, or due-diligence advice. Nothing on the Service, in an Output, or in any communication from Solva constitutes such advice, and no Solva representative is acting in a professional capacity governed by the licensing rules of those professions when generating or discussing an Output.
4. No confirmation of buildability or legal status
An Output does not confirm, and must never be relied upon to confirm: zoning classification, title, ownership rights, concession rights, easements, setbacks, coastal or maritime-zone compliance, environmental approval, water availability, road access, utility availability, slope stability, structural feasibility, municipal or other governmental approval, construction cost, development potential, or buildability. These matters can only be confirmed by qualified local professionals and the relevant authorities reviewing the actual property.
5. Regional property conditions
Property development rules vary by country, province, state, municipality, district, governing authority, title condition, site condition, and property type. Solva may display a regional notice based on the property's stated location; that notice is informational and does not constitute a complete or jurisdiction-specific legal review. The absence of a region-specific notice does not mean no local restrictions apply.
6. Independent professional verification required
Before relying on, marketing, financing, purchasing, selling, permitting, or constructing anything shown in an Output, you must independently verify all relevant facts with qualified local professionals (which may include architects, engineers, surveyors, attorneys, planners, and environmental consultants) and the relevant governmental authorities. Solva is not a substitute for that verification at any stage.
7. User upload rights
You represent and warrant that you hold all rights necessary to upload and submit any photo, map, plan, drawing, location data, property information, or other material you provide to Solva ("Uploaded Materials"), and that doing so does not infringe any third party's intellectual property, privacy, or other rights. You are solely responsible for the legality and accuracy of everything you upload.
8. Accuracy of user-submitted information
You are responsible for the accuracy of the information you provide in a brief (property type, location, dimensions, constraints, vision, and any other field). Solva generates Output based on what you submit; it does not independently verify the accuracy of user-submitted information against the actual property.
9. AI output limitations
Outputs are generated by AI models that can misinterpret a brief, omit a requirement, depict a feature inconsistently across images, or produce a result that does not match the actual site. Solva applies internal design-logic safeguards intended to reduce obviously implausible results, but these safeguards do not guarantee accuracy, completeness, consistency, or real-world feasibility.
10. No misrepresentation
You agree not to represent, market, publish, or otherwise use a Solva Output as: an existing condition of the property, an approved design, a permitted building, a construction document, professional architectural or engineering work, a guarantee of development potential, a confirmation of investment value, or proof of any regulatory approval. Every external use of an Output must retain the disclaimer required under Section 18 (Output disclaimer requirement).
11. Prohibited uses
You may not use the Service to: upload material you do not have the right to use; generate or distribute content that is unlawful, fraudulent, or misleading about a property's actual condition or approval status; misrepresent an Output as professional work product to a buyer, lender, regulator, or other third party; attempt to circumvent, disable, or interfere with the Service's safeguards, rate limits, or disclaimer stamping; or use the Service in a way that violates applicable law.
12. Automated access, bots, and scraping
You confirm, by accepting these Terms, that you are a human user or an authorised representative of a real person or legal entity, and that you are not accessing the Service through any unauthorised bot, crawler, scraper, script, automated account-creation tool, AI agent, or other automated system not expressly permitted under Section 13 (Permitted assistive and ordinary technical use).
You may not access or use the Service through any unauthorised bot, crawler, scraper, spider, script, automated workflow, automated account-creation tool, data-mining tool, extraction tool, or other automated means not expressly permitted under Section 13.
You may not scrape, harvest, copy, extract, download, index, monitor, mirror, compile, or create datasets from the Service's underlying systems, prompts, design methodology, generation systems, templates, visual systems, pricing, user interfaces, workflows, project examples, or other internal service content, without Solva's prior written permission. This does not limit your ordinary use, storage, or external publication of Output you have purchased, which is governed by Section 15 (Ownership and licence to outputs).
You may not use the Service to create high-volume automated project submissions, fake accounts, account farms, synthetic users, benchmark or model-training datasets, or systems designed to imitate, reverse engineer, evaluate, extract, or commercially exploit the Service's underlying systems, prompts, or design methodology.
You may not bypass or attempt to bypass rate limits, access controls, payment controls, watermarking, disclaimers, download restrictions, security measures, usage limits, geographic restrictions, or account controls, including by abusing free or discounted tiers beyond their intended individual use, or engaging in payment fraud or chargeback abuse.
Solva may suspend, restrict, throttle, or terminate access where it reasonably suspects automated abuse, scraping, fraud, misuse, security risk, breach of these Terms, or activity inconsistent with normal individual human use of the Service, and may withhold any pending refund where the suspected breach is the basis for the suspension.
13. Permitted assistive and ordinary technical use
Section 12 does not prohibit ordinary browser functions, password managers, accessibility tools, screen readers, assistive technologies, or reasonable internal business workflows used by an authorised individual. It also does not prohibit using a general-purpose AI assistant or browser-automation tool that you personally direct to complete a single submission you review before sending — provided that, in every case, the tool does not scrape or harvest Service content, generate bulk or unattended submissions, bypass rate limits or other controls, create fake accounts, or misrepresent who is acting.
14. Third-party AI/cloud/payment providers
The Service relies on third-party providers for AI image generation, AI text processing, cloud hosting and storage, and payment processing. Your use of the Service is also subject to the operational availability and behavior of these providers, which are outside Solva's direct control. Solva selects and reviews these providers but does not guarantee their uninterrupted availability.
15. Ownership and licence to outputs
Subject to full payment and your compliance with these Terms, you receive a non-exclusive, worldwide licence to use the Output you purchased for your own marketing, listing, and internal evaluation purposes, always subject to the no-misrepresentation and disclaimer requirements above. Solva retains the underlying generation prompts, model parameters, and any internal working files.
16. Solva licence to process uploads
You grant Solva a licence to use your Uploaded Materials solely to: generate the Output you requested, operate and maintain the Service, provide customer support, and ensure quality control and fraud prevention. This licence does not include using your Uploaded Materials or Outputs for Solva's own marketing or for training AI models — see Section 17.
17. Portfolio/marketing use only with opt-in consent
Solva will not use your project, Uploaded Materials, before/after images, property address, or any other project-specific material in Solva's own marketing, case studies, or portfolio, and will not use them to train AI models, unless you separately and affirmatively opt in. Declining has no effect on your ability to use the Service.
18. Output disclaimer requirement
Every Output Solva delivers carries a disclaimer label and is accompanied by the then-current global disclaimer text. You may not remove, crop, obscure, or otherwise suppress the disclaimer label from an Output before using it externally. Re-cropping or editing an Output in a way that removes the disclaimer is a violation of Section 10 (No misrepresentation).
19. No guarantee of results
Solva does not guarantee that an Output will match your expectations, your client's expectations, or any specific buyer's reaction, nor that an Output will increase interest in, or the sale price of, a property.
20. Packages, correction passes, refunds, and delivery limitations
Package scope, image counts, included correction passes, and delivery timelines are as described on the Service at the time of purchase. Refund eligibility, if any, is as stated in the package description at time of purchase; absent a specific statement, packages are non-refundable once production has begun.
One correction pass is included with every Listing Concept Pack and Developed Visual Pack. A correction pass addresses specific errors or omissions measured against the approved brief — it is not an opportunity to change direction.
Covered by a correction pass
- Missed item clearly listed in the approved brief
- Wrong material direction relative to the brief
- Missing named feature (pool, terrace, landscaping element, etc.)
- Obvious visual error or artefact
- Incorrect image mood if clearly specified in the brief
Not covered
- Changing the architectural direction
- Changing the number of units
- Changing the style family after production has started
- Adding a building not described in the brief
- Changing the camera package
- Requesting a new concept direction
- Vague subjective requests without specific instruction (e.g. "make it more luxury")
21. Limitation of liability
To the maximum extent permitted by law, Solva and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Service or reliance on an Output, even if advised of the possibility of such damages. Solva's total liability for any claim arising from the Service is limited to the amount you paid for the specific package giving rise to the claim.
22. User indemnity
You agree to indemnify and hold Solva harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your Uploaded Materials, your misuse of an Output (including any use prohibited under Section 10, Section 11, or Section 12), or your breach of these Terms.
23. Privacy Policy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
24. Changes to Terms
We may update these Terms from time to time. Material changes take effect once the version above is updated; continued use of the Service after a material change constitutes acceptance of the updated Terms.
25. Governing law and dispute forum
Governing law and dispute forum are being finalized with counsel based on Solva's entity formation jurisdiction. This section will be completed before these Terms are relied on in a dispute.
26. Contact information
The legal contact address for questions about these Terms is being finalized. In the interim, reply to any Solva delivery email and your message will reach the studio.
